Consent Resolutions

The document below addresses public notification of all Consent Resolutions (CR) and Undertakings negotiated between Members and the former BCVMA for the five years (2005 – 2010) prior to the adoption of the new Veterinarians Act SBC 2010 c. 15 (the “Act”) which came into effect on September 15, 2010.

Each of these CR’s was negotiated on the basis that, unless there was a restriction of practice, the CR would not be published. The new Act requires retroactive publication of all CR’s and undertakings for a five-year period prior to the adoption of the Act. Council has directed that publication of these agreements and undertakings should be anonymous.

Following resolutions reached with the Investigation Committee, notification of Reprimands or Remedial Actions by Consent must be published pursuant to s. 68(1)(c) of the Veterinarians Act.

The following registrants have agreed to remedial action following an investigation pursuant to s. 66 of the Veterinarians Act.

11/15/2024
	Registrant: Dr. Sukhvinder Dhillon Complaint File Number: 22-114 Decision: The IC accepted the Consent Agreement executed on November 15, 2024. Description & Reasons: On June 20, 2024, the Investigation Committee approved a Consent Agreement between the CVBC and Dr. Sukhvinder Dhillon, wherein Dr. Dhillon agreed he misdiagnosed a gastrointestinal problem as a benzodiazepine toxicity and did not give sufficient consideration to other differential diagnoses, including simple gastroenteritis and Addison’s disease, which were better supported by the history and clinical findings. Dr. Dhillon also acknowledged that he discharged a patient who was not improving without a sufficient recommendation for further testing or care. Dr. Dhillon consented to remedial action, which included agreeing to complete a total of 12 hours of RACE-approved continuing education in emergency gastrointestinal conditions of dogs (6 hours); endocrinology (3 hours); and toxicology (3 hours). Dr. Dhillon also agreed to pay the CVBC $793.19, representing 50% of the investigation costs, within 3 months of signing the Consent Agreement.

	Registrant: Dr. Nenad Paunovic Complaint File Number: 23-048 Decision: The IC accepted the Consent Agreement executed on November 1, 2024. Description & Reasons: On July 25, 2024, the Investigation Committee approved a Consent Agreement between the CVBC and Dr. Nenad Paunovic, wherein Dr. Paunovic agreed he created medical records that did not comply with the CVBC Bylaws, Professional Practice Standard: Companion Animal Medical Records and Professional Practice Standard: Small Animal Anesthetic Monitoring. Dr. Paunovic consented to remedial action, which included agreeing to complete a total of 3 hours of RACE-approved continuing education in medical record keeping. Dr. Paunovic also agreed to pay the CVBC $1,223.51, representing 50% of the investigation costs, within 3 months of signing the Consent Agreement.

	Registrant: Dr. Tammy Wong Complaint File Number: 23-023 Decision: The IC accepted the Consent Agreement executed on November 1, 2024. Description & Reasons: On July 25, 2024, the Investigation Committee approved a Consent Agreement between the CVBC and Dr. Tammy Wong, wherein Dr. Wong agreed she failed to recognize that a cat had a linear foreign body, failed to develop a differential diagnosis list for vomiting and abdominal pain in a cat that included gastrointestinal foreign body. She further agreed that she failed to offer imaging, which might have diagnosed the foreign body in this instance, and she failed to look under the cat’s tongue, which might have assisted in diagnosing a linear foreign body. Dr. Wong consented to remedial action, which included agreeing to complete a total of 6 hours of RACE-approved continuing education in feline gastroenterology. Dr. Wong also agreed to pay the CVBC $1,853.26, representing 50% of the investigation costs, within 3 months of signing the Consent Agreement.

	Registrant: Dr. Shiv Vashisht Complaint File Number: 23-027(c) Decision: The IC accepted the Consent Agreement executed on September 20, 2024. Description & Reasons: On June 20, 2024, the Investigation Committee approved a Consent Agreement between the CVBC and Dr. Shiv Vashisht, wherein Dr. Vashisht agreed he failed to consider and strongly recommend hospitalization, IV fluids, and urinary catheterization for a cat with evidence of urethral obstruction. He further agreed that he failed to discuss the risks associated with alternative treatment plans for urethral obstructions, i.e. monitoring at home and he administered antibiotics without evidence of a urinary tract infection, contrary to the best practices with respect to antimicrobial stewardship. Dr. Vashisht consented to remedial action, which included agreeing to complete a total of 5 hours of RACE-approved continuing education in feline lower urinary tract disease (4 hours) and antimicrobial stewardship (1 hour). Dr. Vashisht also agreed to pay the CVBC $759.39, representing 50% of the investigation costs, within 3 months of signing the Consent Agreement.

	Registrant: Dr. Sandeep Mann Complaint File Number: 22-027(b) Decision: The IC accepted the Consent Agreement executed on September 13, 2024. Description & Reasons: On June 20, 2024, the Investigation Committee approved a Consent Agreement between the CVBC and Dr. Sandeep Mann, wherein Dr. Mann agreed that he failed to urgently recommend transfer of a recently unblocked cat to a 24-hour emergency hospital for further care at the time of discharge from the clinic, which was closing and he failed to discuss the risks associated with alternative treatment plans for urethral obstructions. He further agreed that he administered antibiotics without evidence of a urinary tract infection, contrary to the best practices with respect to antimicrobial stewardship and he created medical records that do not comply with the CVBC Bylaws, Professional Practice Standard: Medical Record Keeping and Professional Practice Standard: Companion Animal Medical Records.

	Registrant: Dr. Marin Guldie Complaint File Number: 21-079(d) Decision: The IC accepted the Consent Agreement executed on September 6, 2024. Description & Reasons: Dr. Guldie agrees that she made statements in response to inquiries by new clients which, in consideration of the circumstances known to her, were likely to be interpreted by those clients as being critical of the care that had been provided by a previously involved registrant, prior to Dr. Guldie having the relevant discussions with that previously involved registrant. In terms of the Consent Agreement, Dr. Guldie will review and comply with the CVBC Bylaws Part 4 – Ethics and Standards, s. 210. She has also agreed to pay the CVBC $245.06 representing 50% of the investigation costs within three months of being invoiced.

	Registrant: Dr. Ravindra Yadav Complaint File Number: 22-085(a) Decision: The IC accepted the Consent Agreement executed on August 7, 2024. Description & Reasons: On January 25, 2024, the Investigation Committee approved a Consent Agreement between the CVBC and Dr. Ravindra Yadav, wherein Dr. Yadav agreed that he created medical records that did not meet the requirements established in the CVBC Professional Practice Standard: Medical Records Keeping and Professional Practice Standard: Companion Animal Medical Records. Dr. Yadav consented to a reprimand and agreed to pay the CVBC $153.56, representing 50% of the investigation costs within 3 months of signing the Consent Agreement. The requirements of the Remedial Action by Consent have been met, and this matter is now closed.

	Registrant: Dr. Sylvia Tingson Complaint File Number: 23-013 Decision: The IC accepted the Consent Agreement executed on August 1, 2024. Description & Reasons: On May 16, 2024, the Investigation Committee approved a Consent Agreement between the CVBC and Dr. Sylvia Tingson, wherein Dr. Tingson agreed she inappropriately used prophylactic antibiotics after a routine neuter procedure, despite being advised previously that this was not appropriate. She also acknowledged that she created medical records that did not conform to the CVBC Bylaws and Professional Practice Standards for Medical Record Keeping. Dr. Tingson consented to remedial action, which included agreeing to complete the CE course offered by VetMedTeam: “Veterinary Medicine: Medical Records, the Roadmap to Quality Care. Dr. Tingson also agreed to pay the CVBC $889.35, representing 50% of the investigation costs, within 3 months of signing the Consent Agreement.

	Registrant: Dr. Trinity Smith Complaint File Number: 22-069(b) Decision: The IC accepted the Consent Agreement executed on July 19, 2024. Description & Reasons: On May 6, 2024, the Investigation Committee approved a Consent Agreement between the CVBC and Dr. Trinity Smith, wherein Dr. Smith agreed that as designated registrant of Central Animal Hospital, she supplied an inappropriate heating device for use during anesthesia that resulted in a patient suffering from a burn. Dr. Smith consented to remedial action, which included agreeing to pay the CVBC $923.03, representing 50% of the investigation costs, within 3 months of signing the Consent Agreement. The requirements of the Remedial Action by Consent have been met, and this matter is now closed.

	Registrant: Dr. Carey Keith Complaint File Number: 22-069(a) Decision: The IC accepted the Consent Agreement executed on July 19, 2024. Description & Reasons: On May 6, 2024, the Investigation Committee approved a Consent Agreement between the CVBC and Dr. Carey Keith, wherein Dr. Keith agreed that a patient in her care suffered a thermal burn due to her use of an inappropriate heating pad during surgery. Dr. Keith further agreed that she provided false information to a client regarding recall of a product. Dr. Keith consented to remedial action, which included agreeing to pay the CVBC $1855.08, representing 50% of the investigation costs, within 3 months of signing the Consent Agreement. The requirements of the Remedial Action by Consent have been met, and this matter is now closed.

	Registrant: Dr. Jagjit Sandlas Complaint File Number: 22-098 Decision: The IC accepted the Consent Agreement executed on July 4, 2024. Description & Reasons: On February 29, 2024, the Investigation Committee approved a Consent Agreement between the CVBC and Dr. Sandlas, wherein Dr. Sandlas agreed he did not consider post-surgical complications with regards to bladder integrity and the possibility of uroabdomen at an initial recheck 2 days post-surgery when the patient was not doing well, and he did not ensure that adequate post-surgical pain control was provided. He further agreed that he created medical records that do not comply with the CVBC Bylaws, Professional Practice Standard: Medical Records Keeping, Professional Practice Standard: Companion Animal Medical Records, and Professional Practice Standard: Small Animal Anesthetic Monitoring. Dr. Sandlas consented to remedial action, which included agreeing to complete a total of 6 hours of RACE-approved continuing education in the following topics: recognition of post-surgical and anesthetic complications, post-surgical pain management in dogs, and medical record keeping. Dr. Sandlas also agreed to pay the CVBC $1,363.32, representing 50% of the investigation costs, within 3 months of signing the Consent Agreement.

	Registrant: Dr. Jagjit Sandlas Complaint File Number: 22-115 Decision: The IC accepted the Consent Agreement executed on July 9, 2024. Description & Reasons: On February 29, 2024, the Investigation Committee approved a Consent Agreement between the CVBC and Dr. Sandlas, wherein Dr. Sandlas agreed he failed to protect a patient’s airway and consider anesthetic safety when the patient was maintained under anesthesia for a spay surgery with a mask and anesthetic gas. He further agreed that he failed to provide adequate post-surgical pain control following a spay procedure and he created medical records that did not comply with the CVBC Bylaws and Professional Practice Standards for Medical Record Keeping; and failed to comply with the CVBC Professional Practice Standard: Small Animal Anesthetic Monitoring. Dr. Sandlas consented to remedial action, which included agreeing to complete a total of 6 hours of RACE-approved continuing education in the following topics: anesthetic monitoring and safety; post-surgical pain management in cats; and feline-friendly handling practices. Dr. Sandlas also agreed to immediately cease the practice of masking anesthetic for invasive procedures, and pay the CVBC $1 106.55, representing 50% of the investigation costs, within 3 months of signing the Consent Agreement.

	Registrant: Dr. Alana Symington Complaint File Number: 23-003 Decision: The IC accepted the Consent Agreement executed on July 10, 2024. Description & Reasons: On February 29, 2024, the Investigation Committee approved a Consent Agreement between the CVBC and Dr. Symington, wherein Dr. Symington agreed that while acting in the capacity of a designated registrant, she permitted veterinary technicians to perform feline neuters and surgical dental extractions over an extended period of time. Dr. Symington consented to a reprimand, agreed to pay a fine to the CVBC in the amount of $1,000 and she agreed to pay $619.67 representing 50% of the CVBC’s investigation costs within 3 months of signing the Consent Agreement. The requirements of the Remedial Action by Consent have been met, and this matter is now closed.

	Registrant: Dr. Kamin Mamaghani Complaint File Number: 21-110(a) Decision: The IC accepted the Consent Agreement executed on July 4, 2024. Description & Reasons: Dr. Mamaghani acknowledges that he did not provide adequate follow-up communication, or obtain and document informed consent for intermittent monitoring overnight in contravention of the requirement in the Bylaws for explicit consent. Dr. Mamaghani will complete a total of 4 hours of RACE-approved continuing education in post-operative monitoring and agrees to pay the CVBC 50% of the costs of the investigation.

	Registrant: Dr. Howard Thwaites Complaint File Number: 22-032(a) Decision: The IC accepted the Consent Agreement executed on July 4, 2024. Description & Reasons: Dr. Thwaites acknowledges that he failed to diagnose and appropriately treat an upper respiratory infection in a cat, and he inappropriately prescribed an antibiotic (metronidazole) contrary to accepted principles of antimicrobial stewardship. Dr. Thwaites will complete a total of 4 hours of RACE-approved Continuing Education (CE), over and above the amount required for ongoing registration, in each of the following areas: gastro-intestinal disease in cats, upper respiratory tract infections in cats, and antimicrobial stewardship. He has also agreed to pay the CVBC 50% of the costs of the investigation.

	Registrant: Dr. Quinn Gavaga Complaint File Number: 21-049 Decision: The IC accepted the Consent Agreement executed on June 26, 2024. Description & Reasons: On July 20, 2023, Dr. Gavaga agreed that an employee working under his supervision and responsibility failed to correctly operate and monitor anesthetic equipment, resulting in a patient’s death. The requirements of the Remedial Action by Consent have been met, and this matter is now closed.

	Registrant: Dr. Mehdi Hassanzadeh Complaint File Number: 22-125 Decision: The IC accepted the Consent Agreement executed on May 29, 2024. Description & Reasons: On February 29, 2024, the Investigation Committee approved a Consent Agreement between the CVBC and Dr. Hassanzadeh, wherein Dr. Hassanzadeh agreed he performed a non-urgent elective procedure under general anesthetic in a patient who was critically unstable with excessive thirst due to a suspected severe endocrine disease and a possible undiagnosed neurological condition. Dr. Hassanzadeh consented to remedial action, which included agreeing to complete a total of 8 hours of RACE-approved continuing education in the following topics: endocrinology and electrolytes; anesthetic risk assessment and anesthetic precautions in the at-risk patient. Dr. Hassanzadeh also agreed to pay the CVBC $902.07, representing 50% of the investigation costs, within 3 months of signing the Consent Agreement.

	Registrant: Dr. Michael Des Harnais Complaint File Number: 22-121 Decision: The IC accepted the Consent Agreement executed on April 24, 2024. Description & Reasons: Dr. Des Harnais acknowledges that contrary to the CVBC Bylaws, Professional Practice Standard: Medical Record Keeping, and Professional Practice Standard: Companion Animal Medical Records, he failed to complete medical records for a dog who underwent surgery. Dr. Des Harnais has taken proactive steps, including completing continuing education, of his own volition toward ensuring that this type of oversight is avoided in the future. Considering his positive attitude, transparent response, and willingness to accept accountability, the consent resolution does not include an undertaking to pay a fine or a portion of the investigation costs. The requirements of the Remedial Action by Consent have been met, and this matter is now closed.

	Registrant: Dr. Kristina Ringness Complaint File Number: 22-012(a) Decision: The IC accepted the Consent Agreement executed on April 18, 2024. Description & Reasons: On January 25, 2024, the Investigation Committee approved a Consent Agreement between the CVBC and Dr. Kristina Ringness, wherein Dr. Ringness agreed she performed dental extractions incorrectly, leading to the retention of tooth root tips and failed to obtain post-extraction radiographs. Dr. Ringness consented to remedial action, which included agreeing to complete a total of 6 hours of RACE-approved continuing education in companion animal dental extractions, perform future dental extractions competently and take post-extraction radiographs. Dr. Ringness also agreed to pay the CVBC $118.13, representing 50% of the investigation costs, within 3 months of signing the Consent Agreement.

	Registrant: Dr. Jessica Pui Man Lam Complaint File Number: 22-055 Decision: The IC accepted the Consent Agreement executed on April 9, 2024. Description & Reasons: Dr. Lam agreed that she failed to respond sufficiently to a patient recovering poorly in the post-operative period. In terms of the consent agreement Dr. Lam will complete a total of 3 hours of Continuing Education (CE) in post-operative anesthetic complications.

	Registrant: Dr. Aaron Fotsch Complaint File Number: 22-133 Decision: The IC accepted the Consent Agreement executed on April 11, 2024. Description & Reasons: On January 25, 2024, the Investigation Committee approved a Consent Agreement between the CVBC and Dr. Aaron Fotsch, wherein Dr. Fotsch agreed that while acting in the capacity of a designated registrant, he delegated tele-triage services to a non-CVBC registrant, who performed telemedicine, and this constituted the unauthorized practice of veterinary medicine. He admitted that a client was re-directed to a teleservice provider when they called his facility for emergency services and was unable to access a registrant that worked at his facility, despite the client repeatedly communicating with the teleservice provider about the deteriorating condition of her dog, who ultimately passed away. Dr. Fotsch agreed that the non-registrant at the teleservice provider was unprofessional in their client communications. He further agreed that the “emergency services” link on his facility’s website stated that the teleservice provider’s veterinarians provided telehealth services, although these services were provided by non-registrants who were not permitted to provide telemedicine in British Columbia. Dr. Fotsch consented to a reprimand, agreed to pay a fine to the CVBC in the amount of $500.00 and agreed to pay $1354.59 representing 50% of the CVBC’s investigation costs within 3 months of signing the Consent Agreement.

	Registrant: Dr. Nicola Parkinson Complaint File Number: 22-097(b) Decision: The IC accepted the Consent to a Reprimand executed on March 11, 2024. Description & Reasons: Dr. Parkinson acknowledge that she altered the medical records made by another veterinarian without making the proper annotations to preserve the original content and failed to note the author and date of the change, contrary to the CVBC Bylaws and Professional Practice Standard: Medical Record Keeping. Considering Dr. Parkinson’s positive attitude and willingness to accept accountability, the consent resolution does not include an undertaking to pay a fine nor a portion of the investigation costs. The requirements of the Remedial Action by Consent have been met, and this matter is now closed.

	Registrant: Dr. Sylvia Tingson Complaint File Number: 22-031 Decision: The IC accepted the Consent Agreement executed on January 4, 2024. Description & Reasons: Dr. Tingson acknowledges that she failed to use approved warming devices to keep patient ‘Minnie’ warm, and she used devices that are listed as unacceptable in the CVBC Professional Practice Standard: Thermoregulating Devices. She further acknowledges that she did not provide Minnie with adequate peri-operative pain management for an abdominal surgery, and that she did not satisfactorily cooperate with the CVBC’s investigation by failing to respond to the CVBC’s written correspondence in a timely manner. In terms of the consent agreement Dr. Tingson will complete a total of 10 hours of Continuing Education (CE) in the following areas: pain management, including peri-operative pain management, and anesthesia, including thermoregulation. Dr. Tingson has also agreed to pay the CVBC 50% of the costs of the investigation and a fine of $500 within three months of being invoiced.

	Registrant: Dr. Terry Funk Complaint File Number: 22-032(b) Decision: The IC accepted the Consent Agreement executed on October 26, 2023. Description & Reasons: Dr. Funk acknowledges that he failed to diagnose and appropriately treat a respiratory infection in a cat, and he allowed a breakdown in communication with a client to interfere with his clinical judgement. He further acknowledges that he made an inappropriate recommendation for risky, unnecessary surgery in a dehydrated, compromised patient. Dr. Funk will complete a total of 4 hours of RACE-approved Continuing Education (CE), over and above the amount required for ongoing registration, in each of the following areas: gastro-intestinal disease in cats and upper respiratory tract infections in cats. He has also agreed to pay the CVBC 50% of the costs of the investigation. The requirements of this Remedial Action by Consent have been met and the matter has been closed.

	Registrant: Dr. Marcellus Blom Complaint File Number: 22-068 Decision: The IC accepted the Consent Agreement executed on October 29, 2023. Description & Reasons: Dr. Blom acknowledges that he failed to determine or document sufficiently detailed monitoring parameters including physical examinations and examinations of the heartrate from visit to visit, and that he failed to respond to the complainant’s repeatedly expressed concerns regarding the vomiting in reaction to methimazole. He further acknowledges that he provided treatment on July 4, 2022, which did not demonstrate the appropriate level of intensity, monitoring or assessment. In terms of the consent agreement Dr. Blom will complete a total of 8 hours of RACE-approved Continuing Education (CE), over and above the amount required for ongoing registration in each of the following areas: managing feline hyperthyroidism, and management of the critically ill cat. He has also agreed to pay the CVBC 50% of the costs of the investigation within three months of being invoiced. The requirements of this Remedial Action by Consent have been met, and this matter is now closed.

01/05/2024
	Registrant: Dr. Tara Westworth Complaint File Number: 22-025(b) Decision: The IC accepted the Consent Agreement executed on September 28, 2023. Description & Reasons: Dr. Tara Westworth acknowledged that she failed to review and interpret radiographs taken in preparation for a rehabilitation evaluation with her, failed to reassess the radiographs prior to referral for CT in the face of a patient’s worsening condition and failed to prescribe opioids as the case developed and as more information became available. Dr. Westworth will complete a total of 8 hours of Continuing Education (CE), with a minimum of 4 hours in each of the following areas: pain assessment and pain management, and radiographic interpretation and management of bone neoplasia. She has also agreed to pay the CVBC 50% of the costs of the investigation within three months of being invoiced.

	Registrant: Dr. Malwina Mochol Complaint File Number: 22-003 Decision: The IC accepted the Consent Agreement executed on October 29, 2023. Description & Reasons: Dr. Malwina Mochol agreed that she failed to correctly interpret bloodwork, diagnosing serious systemic diseases including anemia, which was not supported by bloodwork and failed to diagnose otitis externa in a patient. Dr. Mochol further agreed that she misinterpreted a normal abdominal radiograph as having an abdominal mass. Dr. Mochol agreed to complete a total of 10 hours of Continuing Education (CE) in the following areas: radiographic interpretation, clinical pathology, and diagnosis and management of otitis exlema. She has also agreed to pay the CVBC 50% of the costs of the investigation within three months of being invoiced. The requirements of this Remedial Action by Consent have been met, and this matter is now closed.

	Registrant: Dr. Kenneth Gummeson Complaint File Number: 22-028 Decision: The IC accepted the Consent Agreement executed on August 25, 2023. Description & Reasons: Dr. Gummeson acknowledges that he failed to acknowledge cardiac disease as a differential for a dyspneic cat, and that he failed to recognize the seriousness of the patient’s condition and provide the client with appropriate options. Dr. Gummeson has agreed to complete a total of 8 hours of RACE-approved Continuing Education (CE), over and above the amount required for ongoing registration, in the following areas: feline thoracic radiographic interpretation, managing dyspneic cats; and cardio-pulmonary disease in cats. He has also agreed to pay the CVBC 50% of the costs of the investigation within three months of being invoiced. The requirements of the Remedial Action by Consent have been met, and this matter is now closed.

	Registrant: Dr. Helene Childs Complaint File Number: 22-059 Decision: The IC accepted the Consent Agreement executed on July 27, 2023. Description & Reasons: Dr. Childs agreed that she used an outdated drug protocol for the sedation of a frail, senior cat when there are well-known, safer protocols available, even for fractious patients, and failed to obtain informed consent by not discussing the risks and adverse effects associated with sedation, and the consent form signed by the client was not appropriate for the specific procedure and its risks. She has further agreed that the medical records did not meet the CVBC Bylaws and professional practice standards for medical record keeping. Dr. Childs will complete a course in veterinary record keeping, and 4 hours of Continuing Education, over and above what is required for ongoing registration, in sedation and anesthesia protocols for frail senior patients. She has also agreed to pay the CVBC 50% of the costs of the investigation within three months of being invoiced. The requirements of this Remedial Action by Consent have been met and the matter has been closed.

	Registrant: Dr. Sukhvinder Dhillon Complaint File Number: 21-097 Decision: The IC accepted the Consent Agreement executed on May 29, 2023. Description & Reasons: Dr. Dhillon agreed that he inappropriately used a topical ophthalmic medication containing a steroid in a patient where the primary diagnoses included corneal ulceration and that he used systemic antibiotics in a manner contrary to the expected standard for antimicrobial stewardship.
